Differences between Home Owners Associations (HOA) and Sectional Titles (ST):

1. When is the complex established?

ST:
Upon registration of the first section transfer.

HOA:
Upon registration of first erf.

2. What forms part of the owner's property?

ST:
All sections in your name, including Exclusive Use Areas (EUA).

HOA:
The erf and everything on it: the buildings and gardens.

3. Who handles the management of the scheme and how?

ST:
The owners elect Trustees annually and who is managed by the sectional title Act and Rules.

HOA:
The owners elect Trustees annually who is managed by the constitution.

4. Who may serve as a Trustee?

ST:
Owners or non-owners allowed.

HOA:
In some cases only owners are allowed.

5. How are levies calculated?

ST:
According to the participation quota, in other words, the size of the unit.

HOA:
Per erf, all owners pay the same amount.

6. What is covered by the insurance policy?

ST:
Building combined insurance and geysers

HOA:
Common property like boundary walls and gates.

7. What has to be covered by the owner's insurance?

ST:
All loose items like furniture and clothes.

HOA:
Buildings on the erf and all the contents.

8. Which maintenance is for the complex's account?

ST:
Common property, like outside gardens and gates.

HOA:
Nothing on the erf of an owner, only common areas like roads.

9. May owners alter the outside of their property?

ST:
Only with the approval of Trustees in accordance of the sectional title Act and Rules.

HOA:
Only with the approval of Trustees in accordance with the Constitution.

10. How does the scheme pay municipal services?

ST:
Water, refuse and sewage are budgeted for and paid via the levies. Rates are for each owner's own account.

HOA:
Each owner is liable for their own services.

11. What does an owner do when the geyser of his property burst?

ST:
Contact the call centre / emergency contact number. It is an insurance claim for the Sectional Title.

HOA:
Repairs and maintenance of everything on the erf is for the owner's account.

12. If the windows leak or the gutter outside the property needs to be repaired. What does the owner do?

ST:
Contact the Trustees for assistance.

HOA:
Repairs and maintenance of everything on the erf is for the owner's account.

13. How does voting work?

ST:
An owner gets one vote per section registered in his/her name.

HOA:
An owner gets one vote per erf registered in his/her name.

14. Are Exclusive Use Areas in the scheme possible?

ST:
Yes, it is registered with Article 27 or Article 27 A

HOA:
No, there are no Exclusive Use Areas in a Home Owners Association.
